EULA - End User License Agreement

APPLOCALIZER SOFTWARE LICENSE AGREEMENT

IMPORTANT: CAREFULLY READ THIS LICENSE AGREEMENT BEFORE USING THIS PRODUCT. SOUTHSOFTWARE.COM LICENSES THE ENCLOSED SOFTWARE TO YOU UPON THE CONDITION THAT YOU ACCEPT ALL THE TERMS AND CONDITIONS CONTAINED IN THIS LICENSE AGREEMENT. IF YOU DO NOT AGREE TO ANY OF THESE TERMS AND CONDITIONS, THEN SOUTHSOFTWARE.COM IS UNWILLING TO LICENSE THE SOFTWARE TO YOU, IN WHICH CASE YOU SHOULD NOT USE THE SOFTWARE AND REMOVE ALL COPIES OF THE SOFTWARE FROM YOUR SYSTEM. BY ACCEPTING THIS AGREEMENT YOU ARE CONSENTING TO BE BOUND BY AND ARE INDICATING YOUR ACKNOWLEDGMENT THAT YOU HAVE READ THIS LICENSE AGREEMENT AND AGREE TO ITS TERMS AND CONDITIONS. YOU FURTHER AGREE TO PROTECT THE PRODUCT FROM UNAUTHORIZED USE, ILLEGAL REPRODUCTION, OR ILLICIT DISTRIBUTION.

APPLOCALIZER SOFTWARE EVALUATION LICENSE GRANT. Southsoftware.com grants you a non-exclusive license to use the Software free of charge for evaluation and trial purposes for a maximum period of thirty (30) days from the date of installation.

APPLOCALIZER SOFTWARE EVALUATION TERMINATION. The license granted and the Software will terminate within thirty (30) days after installation. The license will terminate automatically if you fail to comply with the limitations described herein. You must destroy all copies of the Software upon termination.

TERMS APPLICABLE WHEN LICENSE FEES PAID: LICENSE GRANT. You are granted a non-exclusive license to install and use this Software under the terms stated in this Agreement. You may not rent or lease the Software. You may not copy or reproduce the Software except for creating back-up copies. If (and only if) you have purchased a license to use the Software, you may redistribute components of the software that are a) clearly identified as, "redistributable" in this Agreement, and b) solely along with (or, as a part of) your own software product that essentially make use of the Software. You may not give other people, transfer, sell, modify, decompile, disassemble or otherwise reverse engineer the Software.

You may use the Software on the permanent basis and have the royalty-free right to redistribute and reproduce redistributable components of the Software with only one your own software product that essentially make use of the Software. If you wish to redistribute and reproduce redistributable components of the Software with several software products, you need to purchase the appropriate number of licenses. Your right to use and re-distribute the Software is not limited to a particular territory or territories nor by any time frames. Below is the full and the entire list of Software components that you, the original purchaser, may redistribute along with your software product: the dynamic-link library files applocx32a.dll, applocx32w.dll solely in their original binary executable form.

TERMINATION. This Agreement and the license granted hereunder will terminate automatically if you fail to comply with the limitations described herein. Upon termination, you must destroy all copies of the Software from your system.

LIMITATION OF LIABILITY. The Product is provided "AS IS". You agree that by accepting this license, you are expressly acknowledging that the use of the product is AT YOUR OWN RISK.

SOUTHSOFTWARE.COM MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND ACCOMPANYING DOCUMENTATION.

IN NO EVENT SHALL SOUTHSOFTWARE.COM BE LIABLE FOR ANY DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF SOUTHSOFTWARE.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ACKNOWLEDGEMENT

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND SOUTHSOFTWARE.COM THAT SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN YOU AND SOUTHSOFTWARE.COM RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
